The 'Declaration' in the doctrine of law of The Metaphysics of Morals

Abstract
The 'declaration' is one of the constitutive moments of property acquisition (AA 6 258). This moment must be fulfilled for the acquisition to become real, regardless of the empirical conditions under which the object is acquired or the object itself (AA 6 251-254, 273). However, since the presentation of the attendenda - among which the declaration is included - comes after the exposition of the objects that are appropriable at our discretion (cf. AA 6 247-248), it could be argued that these moments are conditioned by the type of object being acquired, or that the object is conditioned by them. Furthermore, since every 'declaration' requires execution, its alleged transcendental status is put in tension. Nonetheless, it will be demonstrated that this tension is resolved by considering (1) that the origin of every 'declaration' is the original community, and (2) that the 'declaration', based on the original community, is a speech act that does not alter the nature of said community.
