Abstract

This article recognises the main control mechanisms of unfair terms and identifies some of these mechanisms that operate or could operate in the Chilean law. It is concluded that in both cases, inside the 19,496 Act and outside it, is possible to identify such mechanisms however, the lack of a rule to coordinate them, produces a problem of uncertainty for suppliers and consumers.
