Sobre el pragmatismo legal: ¿Dónde nos conduce ‘La senda del Derecho’?

Resumen

Todo esto empieza con un par de preguntas que suenan aparentemente muy sencillas: «¿Qué es el pragmatismo jurídico? y ¿Hay algo valioso en él?». Sin embargo, termina con respuestas no tan simples: «Aquello que hoy en día es llamado “pragmatismo jurídico” es muy diferente del antiguo estilo de pragmatismo jurídico tradicionalmente asociado con Oliver Wendell Holmes; y hay elementos valiosos en la concepción del Derecho revelada a través de la lectura de The Path of the Law [La senda del Derecho] de Holmes a la luz de la filosofía de tradición pragmatista clásica, aunque menos en el neopragmatismo legal contemporáneo». A medida que articulo y defiendo estas respuestas, mis reflexiones sobre las variedades de pragmatismo –filosófico y jurídico, antiguo y nuevo– serán envueltas alrededor de mi exploración del significado de The Path of the Law y las fortalezas y debilidades de sus argumentos.
