Abstract

The enshrinement of the insiders with regard to the natural person debtor has important effects on the interests of certain creditors, such as those who are beneficiaries of alimony or of an economic compensation, that they are owed since before the beginning of bankruptcy proceedings of liquidation or renegotiation. The study of the treatment that the current bankruptcy law has for alimony or economic compensation credits of certain insiders with the natural person debtor, allow us to provide account of the dissatisfaction of this regulation with respect of their interests from the point of view of respect of certain principles of family law, manifested in unfavorable treatment and in many cases harmful.
