Abstract

This article aims to explain the importance of the new lex mercatoria in international sales, as also clarify the legal nature of Incoterms, which is part of this. Understanding that although they are customs and practices of international business, and have not been created by any sovereign state, is constantly used in international sales, regulating a number of particular aspects of the contract, in order to provide greater security the globalized international trade. The last regulation of Incoterms 2010 also addressed, highlighting the changes and new applications that have been created as well as their use in Chile.
