Abstract

This article addresses an issue of constant controversy in courts of law, concerning the possession of notorious civil status, analyzing its origin and evolution, seeking to determine its legal nature, is it an institution or a means of proof?, If the primacy of biological tests are in accordance with our Charter, and the possible collision of right. We will analyze the different aspects that comprise the right to identity and its relation to the notorious possession of civil status. Finally, it is the procedural way of claiming Is it possible to allege the possession of notorious civil status as the basis of a claim action or challenge?
