The purpose of this paper is to make a general analysis of the inapplicability of unconstitutionality, as well as its effects and to compare it with the system of constitutional control in the United States of America (which was the inspiration for to establish the inapplicability of the 1925’s Constitution) as in certain countries of continental Europe (Austria and Spain), which today are closer to our system.
