Duty of the parties to consider the use of mediation in the project of the civil procedural code. Comparative analysis

This paper will focus on the study of the duty of the parties to consider the use of mediation, as one of the incentives established by the Civil Procedure Code project to promote the use of alternative mechanisms. The specific objective of this paper will be to formulate a proposal for concrete improvements to the regulation of the aforementioned duty of the parties, once the jurisdictional route has been initiated, in the aforementioned project of the Code. For this, the study will be divided into three parts. The first part, we will proceed to describe and contextualise the regulation of the aforementioned duty in such project. In the second part, the aforementioned proposal will be compared the regulation of this matter in the Spanish Civil Procedure Law, the federal regulations of the United States and the rules of civil procedure of England and Wales. Finally, based on the findings of the aforementioned comparative review, a proposal for concrete improvements to the regulation of the duty of consideration of mediation contained in the draft of the new Chilean Civil Procedure Code will be formulated.
